General :-

The Consular Section of the High Commission of India provides consular services pertaining to issue of visas, Indian passports and other miscellaneous consular services like attestation of documents, etc. The visa and passport counters are open for the public from 9.30 AM till 12.00 Noon on all working days (Monday to Friday).However all the applicants are required to collect their  respective  token numbers from counter no.3  and submit the applications on their turn . As a maximum of 150 tokens for passport/consular services and 100 tokens only for visa services are issued per day  the applicants are advised to collect the tickets on opening of the counters at 9.30 A.M.

Blank application forms for passport or visa services can be collected at the respective counters in advance without waiting for the numbers to be called. The application forms can be downloaded from the web and the photocopies of the same can also be used. The normal processing time for most of the miscellaneous  consular services l is one working day. The time for collection of the documents is between 4.30 PM to 5.00PM.Same day facilities are provided to persons requiring emergency services like urgent medical treatment , death of near relatives etc. However requests for such services should be supported with documentary proof regarding the emergency. Requests for urgent service  on the grounds of having  ticket for immediate travel/confirmed bookings will not be entertained.

All Indian nationals are advised to register themselves with the High Commission of India for which a form is available on the web. The registration is in the interest of individuals and also helps the Consular Section in providing services in cases of emergencies

 

VISA SERVICES :- ^ TOP

Various types of visas are issued depending upon the purpose like:

(a) Tourist visa for visiting places in India, meeting relatives/friends, pilgrimage and recreation;

(b) Student visa for those intending to pursue school / college level education (Letter from the school authorities is required to be attached);

(c) Business visa for businessmen & entrepreneurs to attend meetings, to establish joint ventures, for investment purposes, etc. (Letter from inviting authorities and Letter from the local sponsoring company to be enclosed);

(d) Employment visa for those who undertake employment in registered firms and companies duly approved by concerned Ministries in India (Letter of employment, contractual terms and copy of the registration of the company required to be produced); and

(e) Transit visa restricted to maximum of 72 hours (Onward journey ticket to be produced).

The applications for visa should be accompanied by three passport size photographs of the applicant and the same can be submitted in person , through travel agents or any authorized person. We do not insist on personal visits to the High Commission. For those holding Malaysian passports it may take 2-3 working days to issue visas and for those holding passports of other countries it may take 4-5 working days to issue visas. However, in certain categories of cases, the issue of visa is subject to receipt of specific clearances from the concerned authorities and therefore in such cases no time limit can be specified.  The fees for various types of visas as on 1.10.00 which are subject to change in future are enumerated as under: -

INDIAN PASSPORT/CONSULAR SERVICES:- ^ TOP

The services provided and the requirements for the same are as follows:

(a) Issue of new Indian passports in lieu of the old passports. Application form (EAP-1) needs to be filled in and submitted along with four recent photographs. Applications for new passport are accepted when the old passport is valid for less than one year.

(b) Extension in the validity of the existing passport. Application form (EAP-2) needs to be filled in and submitted along with two photographs and a copy of the passport.

(c) Issue of additional booklets to the valid passports. Application form (EAP-2) needs to be filled in and submitted along with four recent photographs,

(d) Duplicate passports in lieu of the lost/damaged passports. Application form (EAP-1) to be submitted along with additional particulars pro forma, police report, copy of the passport and ten photographs.
Documents relating to legal stay in Malaysia to be submitted .

(e) Registration of births/deaths of Indian nationals. Application forms available at the counter need to be filled in and submitted along with the birth/death certificate along with other documents.

(f) Separate passport for children. Application form (EAP-1)to be filled in and submitted with four copies of photograph along with mother’s passport and a copy of father’s passport. A no objection letter from both the parents for issue of separate passport to the child also needs to be submitted.

(g) Inclusion/deletion of particulars of children from the passports. Application form (EAP-2) to be filled in and submitted along with passport and relevant documents.

(h) Attestation of legal/civil documents. The original document along with a copy of the same may be submitted.

(i) Issue of travel documents to stranded Indian nationals. Application form (EAP-1) to be submitted along with police report, four photographs, copy of passports and other documents in proof of identity.

PERSONS OF INDIAN ORIGIN CARD SCHEME:- ^ TOP

PRESSNOTE

Understanding the sentiments of persons of Indian origin to be closer to their original country and to reinforce their emotional bonds, as well as respecting their desire to participate in the development of the country of their origin, the Government made an earnest resolve to frame a special scheme. This resolve was translated in the first Budget Speech of FM:

"Government have decided to draw up a Scheme for issuance of a Persons of Indian Origin (PIO) Card for those living abroad and having foreign passports. The PIO Card, which would be extended to Persons of Indian Origin settled in countries to be specified by Government would besides introducing a visa free regime, also confer some special economic, educational, financial and cultural benefits. The details are being worked out."

2.The Government has launched a comprehensive Scheme for the Persons of Indian Origin – called the "PIO Card Scheme". Under this Scheme, Persons of Indian Origin upto the fourth generation (great grand parents) settled throughout the world, except for a few specified countries, would be eligible. The Card would be issued to eligible applicants through the concerned Indian Embassies/High Commissions/Consulates and for those staying in India on a long term visa, the concerned Foreigners Regional Registration Officer (Delhi, Mumbai, Calcutta, Chennai) would do the same.

3.The fee for the card, which will have a validity of 20 years, would be US $1000.00.

4.Besides making their journey back to their roots simpler, easier and smoother, this Scheme entitles the PIOs to a wide range of economic, financial, educational and cultural benefits. The benefits envisaged under the Scheme include:-

(i) No requirement of visa to visit India

(ii) No requirement to register with the Foreigners Registration Officer if continuous stay does not exceed 180 days. If continuous stay exceeds 180days, then registration is required to done within a period of 30 days of the expiry of 180 days

(iii) Parity with Non-resident Indians in respect of facilities available to the latter in economic, financial, educational fields etc.

These facilities will include:

(a) Acquisition, holding, transfer and disposal of immovable properties in India except of agriculture/plantation properties

(b) Admission of children in educational institutions in India under the general category quota for NRIs – including medical/ engineering colleges, IITs, IIMs etc.

(c) Various housing schemes of Life Insurance Corporation of India, State Governments and other Government agencies

(iv) All future benefits that would be extended to NRIs would also be available to the PIO Card holders

(v) However, they shall not enjoy political rights in India. The above steps would go a long way in renewing and strengthening the emotional bond amongst PIOs with the land of their origin. The attractive features of the Scheme will further exhort them to play an increasingly constructive role in the socio-economic and cultural development of the country of their origin

INSTRUCTIONS FOR APPLICATION FOR REVISED P.I.O. CARDS SCHEME 2002 :- ^ TOP

1. Eligibility:

Any person:-

(a) Who at any time held an Indian Passport; or

(b) He/she or either of his/her parents or grandparents or great grandparents was born in and permanently resident in India, provided neither was at any time a citizen of any of the specified countries.

(c) Who is a spouse of a citizen of India or a Person of Indian Origin as covered under (a) and

(b) above.

2. Facility extended to a PIO Card Holder:-

(a) A PIO Card holder shall not require a separate visa to visit India.

(b) A PIO Card holder will be exempt from the requirement of registration of his stay on any single visit in India does not exceed 180 days.

(c) In the event of continuous stay in India of the PIO Card holder exceeding 180 days, he/she shall have to get himself/herself registered within 30 days with the concerned Foreigners Regional Registration Officer/Foreign Registration Officer.

(d) All PIOs including PIO Card holders, shall enjoy parity with NRIs in respect of all facilities available to the latter in the economic, financial and educational fields except is matters relating to the acquisition of agricultural / plantation properties. No parity shall be allowed in the sphere of political rights.

3. Validity of PIO Card:

A PIO Card shall be valid for 15 years from the date of issue subject to the validity of the passport of the applicant.

4. Fee:

(a) The fee for PIO Card will be Rs. 15,000/- (fifteen thousand only) payable along with the application.

(b) PIO Card to children upto the age of 18 years will be issued at a fee of Rs. 7,500/- (seven thousand five hundred only).

(c) Payment is to be made in Malaysian Ringgits.

5. Documents:
(a) Primary Documents / Proof:

Indian Passport/travel documents of the applicant or either of his / her parents or grandparents or great grandparents.

(b) Secondary Documents / Proof:

(i) Passport of the foreign country indicating the place of birth of the applicant in India

(ii) Any other documents satisfactorily proving the residence/nationality as an Indian e.g. revenue records / domicile certificates / school / college leaving certificate, etc.

6. Status of Existing PIO Cards:

PIO Cards issued under the scheme notified in 1999 at US$ 1000/- will continue to remain valid. While no refund shall be admissible, the validity of such cards would be extendable for a further period of 10 years (i.e. 30 years in all), if so applied by the Card holder, without extra cost

Manpower from India :- ^ TOP

India provides skilled manpower in the IT Sector and the professional areas like medicine, engineering and teaching facilities to Malaysia. However, India has not been a source of unskilled manpower for other services and construction sector. Notwithstanding this, Malaysian Companies are permitted by Govt. of Malaysia to employ Indian labour in certain sectors on case to case basis. In order to streamline the terms of employment during their stay in Malaysia, which includes the conditions of working between the employer and the employee, liabilities of the employer, repatriation procedure etc., an employment contract has been introduced as under.

Company Profile

Memorandum & Article, Form 9, Form 24, Form 49 ( Certified true copy by the Company's Secretary )

Letter of Reference from concerned Malaysian Chamber of Commerce (certifying that membership and assuring that company will comply with the terms of contract) .

  • In case workers have already been selected, Item (D) & (E) shall not be required but EMI Form shall be filled up by the employer who shall pay levy, make insurance and arrange Bank Guarantee for the workers and shall submit the documents with other requirements listed above.
  • No alteration/variation to the contract of employment will be accepted.
  • Serial No. 5 to 8 are required to be signed by Director of the company .The contract of employment is to be signed in the Consular Wing of High Commission of India.
  • Photocopy of passport of each employee (page No. 1,2,3 and last page) attached with the employment contract.
  • Serial No. 5 to 8 are to be submitted in triplicate.
  • Minimum processing time : 1 week
  • The High Commission of India reserves the right to reject any application without assigning any reasons thereof.

DURATIONS:

4. The duration of the Contract will be for a period of ……………….. Years Commencing on the day of arrival of the Employee in ……………………… This term of service may be determined as extended as hereinafter provided in Clause 17 of this Contract.

WAGES: *

5. (a) The Employee will receive a minimum wage / salary of RM…………...(excluding allowances and overtime) The Employer undertakes to provide the Employee with not less than 6 days’ Per week (as prescribed by the Ministry of Labour, Malaysia).

(b) At the request of the Employee, the Employer will advance an amount not exceeding 4 weeks’ Wages/Salary prior to embarkation at …………………… The advance will be repaid by the Employee in (12 weeks / 3 months) installments to be deducted from his/their wages/salaries.

(c) Wages will be paid by the Employer at the end of the month.

HOURS OF WORK

6. Hours of work shall be eight (8) hours from Monday to Saturday.

* The minimum wage for Skilled Worker ------- RM 1000/- ( excluding allowances and Overtime)

Unskilled Worker ------- RM 600/- (excluding allowances and Overtime)

OVERTIME:

7. The basic pay per month without O.T…………………. If the Employee works more than eight (8) hours on any working day, he will receive overtime allowance payment at the rate of time and a half of ordinary time. The Employee may only be asked to work overtime with his consent and shall not be permitted to work overtime for more than two hours in any period of twenty-four hours.

8. (a) The Employee will be entitled to one day’s rest in each week, normally on Sunday. In the event of his working shift, the Employee will agree to take his rest period on any day of the week , provided he is not required to work for a longer period than six consecutive days without a rest day.

(b) The Employee will be entitled to ten (10) paid holidays in each year, which be either public holidays peculiar to the employee’s race. The ten paid holiday are :

  • Labour Day
  • National Day
  • Yang Di-Pertuan Agung’s Birthday
  • Federal Territory Day
  • Chinese New Year
  • Hari Raya Puasa
  • Deepavali
  • Christmas
  • Awl Muharam
  • New Year

(c) In the event of any Employee, not on shift work, being asked to work, on Sunday or on any paid holiday, he will be entitled to be paid at one and half and double rates respectively, for the period of work.

INTERRUPTION TO WORK

9. If on any working day for any reason outside the Employee’s control the Employer is unable to provide work, and Employee attends for work at the place of employment, the Employee will receive wages as if he had worked for the period required on that day. If the Employee fails to attend at the work place without a proper excuse, he will not receive wages for the period of his absence. No monitory fine or deduction will be made in employee’s salary.

( Notes: Clauses 6 to 9 do not apply to Domestic Helpers, Cooks, Temple Priests & Musicians ).

PASSAGE

10. (a) The Employer will provide the Employee with free air passage from India to Malaysia. Likewise the Employee will receive free return air passage on the expiration of the contract. The Employee must be prepared to travel by air as the Employer shall direct.

(b) Should the Employee be unavoidably delayed in Malaysia after the termination or expiry of the contract will continue to receive his wages pro rate until the day on which he embarks for.

(c) Should the Employee fail to fulfill the expectation of the employer, his salary shall not be reduced or deducted in any way. The Employer will provide the return air ticket for this repatriation after settling the dues, if any.

TRAVEL DOCUMENT AND MEDICAL EXAMINATION

11. (a) The Employer will undertake to obtain on the Employee’s behalf all necessary travel document free of charge to the Employee and will further arrange for the Employee to be examined free of charge by a Registered Medical Practitioner.

(b) The Employer / Company shall undertake to renew the work permit in time.

(c) The Employer will undertake to apply for worker’s pass from the Immigration to enable the Employee to travel freely in the vicinity area – place of stay.

(d) In the event of detention of the employee by the Immigration/police for whatsoever reasons, the employer shall arrange release of said employee and continue to employ. In case the employee is unable to be taken back for work, the employer shall arrange repatriation at his own cost.

(e) The Employer will not engage any agent to renew the passport/work permits of the employees. The Employer or and authorized officer of the organization will undertake all the necessary steps for this purpose.

(f) The Employee recruited will be received by the Employer on arrival at the airport.

ILLNESS OR ACCIDENT INSURANCE

12. (a) The employee will be insured for minimum RM 20,000/- against sudden death on his joining duties in Malaysia. Letters in respect of Workmen’s Compensation Insurance and Company’s Group Insurance are attached herewith.

(b) The employee will be insured for Hospitalisation/Medical treatment expenses.

(c) In the event of any illness or accident arising out in the course of his employment, the Employee will be paid compensation on terms not less favourable than those provided under Malaysian Employment Act, 1955 and the Company’s Group Personal Accident Policy.

(d) In the event of any illness or accident not attributable to his employment and provided the Employee immediately informs the Employer’ Medical Practitioner, the Employee will be provided with free medical and hospital attention by the Employer. Full Wages will be paid for the first month of incapacitation and half wages for the next month. Subsequently, free medical and hospital attention will continue, but no wages will be paid.

(e) The Employer will ensure security of the workers in the workplace and in the hostel.

(f) If any Employee dies in harness, the Employer will arrange repatriation of the dead body and will pay compensation as laid down in Foreign Workers Compensation Scheme.

MEDICAL AND ACCOMODATION / LEVY & WORK PASS

13. The Employer shall provide to the Employee, during the term of service the following :

(a) Free medical attention

(b) Free accommodation - the accommodation should contain at the minimum, cot with mattress, locker facilities and other basic amenities including convenient and sufficient toilet facilities.

(c) The charges for work pass and levy will be borne Fully by the Employer and he will not deduct from the wages/salary of the employee.

(d) The premium of Bank Guarantee given by the Employer to the Immigration shall not be deducted from the wages/salaries of the employee.

(d) Free transportation from the place of residence to work place and back.

REMITTANCES

14. The Employer will provide free of charge, facilities for the Employee to make remittances to his/her family of dependants in India.

FAMILY

15. Nothing in the terms of this Contract will be construed as permitting the Employee to bring his family to Malaysia.

TERMINATION

16. (a) In the event of the Employer wishing to terminate this Contract, he shall give one month’s notice or one month’s wages in lieu of notice to the Employee, and shall provide free return air passage to India.

(b) In the event of the Employee wishing to terminate this Contract, he shall give one month’s notice or forfeit one month’s wages in lieu thereof to the Employer. In this event, he will be entitled to receive from the Employer the cost of return air passage and the salary till the date employee is repatriated.

(c) Even if any employee is terminated on health/disciplinary ground, he will be repatriated on the expenses of the employer.

(d) The Employer has to ensure repatriation of sick/disabled workers whatsoever may be the cause of disability/sickness at the expenses of the company.

(e) The employer shall complete the formalities for release of EPF to the employee besides settling all payments due. The employee shall be allowed to stay in the accommodation till the date of his repatriation.

EXTENSION

17. Should the Employer and the Employee wish to extend the duration of this Contract for further 1 year, they may do so provided the Emigration Authorities of India and Malaysia do not require the Employee to return to India prior to the extension taking place.

VARIATION

18. Any variation or addition / deletion to the terms of this Contract during its normal duration will be made only with the consent of the competent authority in India/ the High Commission of India, Kuala Lumpur.

LAWS

19. The Employee, during the course of this Contract, will be subject to the laws of Malaysia.

SIGNING OF THE CONTRACT


20. (a) This Contract will be signed in Malaysia by the Employer in Indian High Commission and by the Employee in India before the Protector of Emigrants’ the competent authority to whom all complaints concerning the execution of this Contract should be made.

(b) The Employer will not enter into any other agreement with the Employee other than approved. Employer will provide copy of Collective Trade Agreement with Trade Unions, if any.

(c) The Employer accede to the request of the Mission officials to visit the workplaces and workers hostel with prior information to look into the welfare of the Indian workers.

COMPLAINTS

21. (a) All complaints concerning the terms of this Contract must be made before the Labour Department of the concerned state and copy to Directorate of Labour, Kuala Lumpur and the High Commission of India, Kuala Lumpur.

(b) The employer shall not keep the passport of the employee in his custody without the consent of the employee.

(c) The employer shall not resort to any vindictive/dilatory action against the employee and shall not use violence or coercion against the employee.

(d) The Employer agree that in the event of failure to comply with the above, the aggrieved worker may seek redress from the relevant authorities in Malaysia.

REGISTRATION WITH THE HIGH COMMISSION OF INDIA, KUALA LUMPUR

22. The employer will register the employee with the High Commission of India in Kuala Lumpur within 10 days of the arrival of the employee in Malaysia.

INTERPRETATION

23. In the interpretation of this Agreement only the English text will be accepted.

AS WITNESS the hands of the parties hereto the day and year first above written.

TIME FRAME :- ^ TOP

The Consular Section functions from 9.30 a.m. to 12.00 noon (from Monday to Friday) during which applications for visas and Indian passports are received. The visas are issued on the following day between 4.30 p.m. and 5.00 p.m. in respect of Malaysian nationals. (For others a processing period of 3working days is required). New and additional passports are given on the following day between 4.30 and 5.00 p.m. whereas renewal and miscellaneous services are given on the same day. The Consular Section adopts a system of token for maintenance of queue and has provided basic amenities in the Chancery including TV , soft and hot drink dispensers.
